All the foregoing elements shall collectively be deemed an “Entry.” Limit five (5) entries per person/email address/household/Pinterest account.
ADDITIONAL REQUIREMENTS OF ENTRY:
To be eligible for Contest judging and prize award, an Entry must meet, and each Entrant hereby warrants by submission of his/her Entry the truthfulness and accuracy of, the following additional requirements:
Round 1: PRELIMINARY JUDGING: On or about 9/18/12, a qualified panel of judges will judge all eligible Entries received based on the following criteria:
The twenty (20) entrants with the highest scoring Entries (provided a sufficient number of eligible entries are received) will be repinned on the Scotch Brand Expressions board and will advance to Round 2 of judging, which will be conducted via Public Voting as described below. In the event multiple Entries from the same Entrant score among the highest entries overall, only the highest scoring Entry will advance to the Round 2. Multiple Entries from the same Entrant cannot advance to Round 2. In the event of a tie during Round One, the Entry with the highest score for Execution will be deemed the winner. In the unlikely event a tie still exists, the Entry with the highest score for Creativity will be deemed the winner. The judges’ decisions on all matters pertaining to judging are final and binding and are not open to appeal. If fewer than 20 eligible entries are received, all eligible entries will advance to Public Voting.
Round 2: PUBLIC VOTING: Beginning on 10/1/12 at 10:00:01 a.m. ET and ending at 11:59:59 p.m. ET on 10/15/12 (“Voting Period”), members of the public who have a Pinterest account can go to Pinterest.com/ScotchBrand and like or repin the entries based on the following criteria: Creativity (60%) and Presentation (40%). A like will count as 1 vote and a repin will count as 2 votes. Entries must be liked or repined from the Scotch Brand Pinterest page in order to be counted. Limit to one (1) like and one (1) repin per person.
The three (3) Entrants submitting the Entries that receive the most number of eligible votes will advance to Round 3: Final Judging, subject to verification. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, using automated pinning programs or offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion.
In the event of a tie during Public Voting, the Entry with the highest score from Round 1 will advance to Final Judging. In the event of a tie during Round One, the Entry with the highest score in Round 1 for Execution will advance to Final Judging. In the unlikely event a tie still exists, the Entry with the highest score for Creativity from Round 1 will advance to final judging.
Round 3: FINAL JUDGING: After the three finalists have been selected through Public Voting (on or about 10/18/12) and verified as necessary, scores from the qualified panel of judges will determine which entrant will be declared the Grand Prize Winner, based on the following criteria:
The Round 3 finalist with the highest scoring Entry will be declared the Grand Prize Winner, subject to verification. In the event of a tie during Round Three, the Entry with the highest score for Presentation will be deemed the winner. In the unlikely event a tie still exists, the Entry with the highest score for Creativity will be deemed the winner.
The judges’ decisions on all matters pertaining to judging are final and binding and are not open to appeal. Potential prize winner will be notified by phone or email on or about 10/24/12.
One (1) Grand Prize and two (2) runners-up prizes will be awarded. The Grand Prize consists of one (1) 4- to 7-day Cruise & Crop crafting or scrapbooking cruise for the winner and one (1) guest, sharing accommodations of one (1) room, as well as two (2) round-trip economy class airline tickets to the port of departure. Odds of winning depends on the number of eligible entries received. The winner and the guest must travel on the same itinerary. Tickets are subject to availability and not guaranteed until ticketed. Tickets are non-refundable once booked. The prize consists of accommodations for the winner and one (1) guest (same stateroom) and most shipboard meals (certain alternate dining options require payment of a fee). Room category will be assigned by Sponsor. All expenses and costs associated with the acceptance or use of any prize that are not expressly specified in these Official Rules as being part of the Grand Prize (including without limitation transportation to or from airports, ground transfers, shore excursions, hotel service charges, personal onboard expenses, or applicable passport, visa and entry/exit fees) are the responsibility of the winner. Guests under the age of 21 years (whether that be the Grand Prize winner or not) must be accompanied by a parent, relative or guardian 21 years or older in the same room. The prize is non-transferable, non-refundable, non-negotiable for cash, may not be resold, and cannot be used as partial payment toward a different Cruise & Crop cruise or room category other than that assigned. No substitution of the prize or any component thereof is permitted, except in the discretion of Sponsor, which reserves the right to substitute a prize or prize component of equal or greater value. Any difference between the stated approximate retail value and the actual value will not be awarded, except at the sole option and discretion of the Sponsor. Tickets must be booked before January 31, 2013 and trip must be scheduled prior to December 31, 2013. Approximate Retail Value of Grand Prize is $4,000 or less. The two (2) Runners-Up Prizes consist of $500 to be awarded in the form of a check written in the name of each runner-up. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value for any and all prizes. No other substitutions or transfer of prizes allowed unless specifically authorized by Sponsor. Limit 1 prize per person.
GENERAL: The Winners are responsible for payment of any income taxes on prizes under applicable federal, state and local laws. Each Entrant submitting an Entry selected for Public Voting will be required to sign and return an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity Release (where legal) (collectively, the “Eligibility Documents”), within 5 days of notification. The Eligibility Documents may additionally confirm an Entrant’s grant of the license to Sponsor in such Entrant’s project as specified above. In the event of non-compliance with these requirements, an Entry may be declared ineligible and an alternate Entry selected for Public Voting. Without limiting the foregoing, in the event that a prize or prize notification is returned as undeliverable, such prize will be forfeited and prize will be awarded to an alternate Entry with the next highest score in Round Three (as applicable), at the Sponsor’s sole discretion.
By entering the Contest, each Entrant, on behalf of himself/herself, and his/her executors and heirs, agrees (a) to be bound and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and binding and not open to appeal; (b) to release, indemnify, defend and hold harmless Sponsor, Hunter Public Relations, and each of its and their parents, subsidiaries, affiliates, members, shareholders, agents, representatives, employees, suppliers, agencies, successors, assigns, licensors, advertising or promotional agencies and any prize-sponsoring agency (collectively, “Released Parties”), from any and all liability whatsoever in connection with or related to this Contest, including, without limitation, from any and all causes of action, liabilities, suits, claims (including but not limited to, third party claims that may be made against Entrant, and claims arising out of or relating to acceptance, receipt, possession or use/misuse of any prize, or any publicity or other public exposure of Entrant, including without limitation, claims concerning infringement or invasion of Entrant's privacy or publicity rights, or defamation, or acts undertaken in preparation for, or participation in, the Contest), cross-claims or counterclaims, costs, injuries, losses or damages or demands of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”), WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF A RELEASED PARTY; (c) that he/she has no right to bring, and covenants not to bring, any claim, action, or proceeding of any kind or nature whatsoever against the Released Parties; (d) to assume all risks, express or implied, associated with all Claims released above, including without limitation, all risks concerning entry into and participation in the Contest; and (e) that NONE OF THE RELEASED PARTIES HAVE MADE OR MAKE OR ARE RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, RELATIVE TO THIS CONTEST OR A PRIZE, AND ALL PRIZES ARE TENDERED TO ENTRANTS ON AN “AS IS” BASIS. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE OF ANY PROMOTION MATERIALS OR ANY PRIZE.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
Repetitive automated electronic submission of entries or votes of any kind are prohibited, and any such entries or votes will be disqualified.
Neither Sponsor nor its agents or representatives is responsible for (a) typographical errors, omitted details or any other errors submitted by Entrants, or errors in the printing of these Official Rules, the administration or fulfillment of the Contest or the announcement of prizes; (b) lost, late, illegible, incorrect, incomplete, misdirected, misaddressed, garbled or otherwise mutilated, stolen or delayed Entries; (c) errors, omissions, interruptions, deletions, defects, destruction, theft or unauthorized access to, or alteration of entries or other problems (whether due to technical problems, human error or any combination thereof); (d) telephonic, mechanical, electronic, hardware or software program, network, Internet or computer malfunctions, communications line or other failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of Entries; or (e) any delay experienced by Entrants due to (i) variations in the speed with which different Internet servers or connections receive, send and otherwise process digital information or (ii) any other technical reason, whether due to the nature of digital systems and the Internet or otherwise.
Without limiting anything set forth elsewhere in these Official Rules, in case of any dispute, entries will be deemed submitted by the Authorized Account Holder of the email account specified on the Entry. “Authorized Account Holder” is defined as the natural person who is in control of the email address specified on the Entry. Any Entrant may be required to provide Sponsor with proof that he/she is the Authorized Account Holder of the email account associated with his/her Entry. An Entrant’s Entry will be disqualified, at the sole discretion of Sponsor, if he/she attempts to (a) enter the Contest through any means other than described in these Official Rules; or (b) disrupt the Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Contest. Notwithstanding anything to the contrary contained in these Official Rules, Sponsor further reserves the right, in its sole discretion, to suspend, modify or cancel the Contest, or any portion thereof, if it cannot be run as originally planned, including by reason of tampering, unauthorized intervention or fraud; infection by computer virus; malicious software attacks, bugs or other problems; or force majeure or other causes beyond the control of Sponsor which impair the integrity or corrupt the administration or security of the Contest. In such event, the Contest shall be conducted from among all eligible Entries received prior to suspension, modification or cancellation, if any, prior to the date on which the event that compromised the Contest occurred.
Except where prohibited and subject to the releases and other provisions of these Official Rules, each Entrant: (1) agrees that any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in St. Paul, Minnesota; (2) agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event shall include attorneys' fees associated with participation in the Contest; (3) agrees that no indirect, punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, “Special Damages”); and (4) waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO A PARTICULAR ENTRANT(S).
